itsNits Posted October 6, 2020 Report Share Posted October 6, 2020 Approval of H1B from Company A: May 29 STEM OPT application submitted from A: June 09 Laid off from Company A: July 7th Hired by new Company B: August 5th STEM OPT updated documentation with Company B: August 19 H1B transfer filed by Company B: August 25th H1B transfer filed by Company B got approved: Sept 04 STEM OPT approved from B: Sept 23rd Company A re-hiring offer letter- Sept 25th Questions: 1. It seems the company has not yet withdrawn the H1B and want to re-hire me now. I am with company B since August 5 and started with H1B status on Oct 1 with them. Can I join company A as they still have an approved H1B petition or there will be a transfer of H1B required(change of employer) from in this case? 2. What needs to be done in case they have withdrawn my H1B? 3 In case transfer is required, what documentation is required? any risk? Quote Link to comment
