RIKB Posted October 3, 2020 Report Share Posted October 3, 2020 I have an existing I140 from an old employer with PD - Nov 2010(EB3 - India) and I have used that couple of times for previous H1B transfers. I am again transferring my h1b this month due to change of employment. According to the Visa bulletin, for the month of Oct 2020 USCIS will use the date for filing chart(EB3 India - Jan 2015) for all visa categories for I485. So technically I am current though the EB3-Final Action date(India) is still Jan 2010. So in such a case will USCIS still grant H1B for 3 years or is it 1 year? Thanks. Quote Link to comment
