Am I Eligible for Stamping now

Hi,

              Posting on behalf of a friend,

              First time Stamping, did not go out of the Country from five years, recently Amendment approved, Only Client changed, same Employer from five years, is he eligible to go for Stamping in India in December? As there are some new Rules for the eligibility?  Please let me know.

Please check your I129 petition below, if it's satisfied you will be eligible for an interview.
Consular officers can refer to Part II, Question 2 of the approved Form I-129 to determine if the applicant is continuing in “previously approved employment without change with the same employer.”

If not above then your salary must be 15% more than the prevailing wage(refer you LCA for prevailing wage and your wage).

If you are in a senior position like a senior manager, director, etc. .. there is a chance.

Above all, I don't think we have a slot for the visa interview. Even if we get one and we do satisfy or don't satisfy these conditions, its up to the visa officer to grant us a visa or not.
