Employer Moved to different state during PERM Process

Hi 

I am with my current employer on H1B from past 12 years. They started my PERM process and my I140 approved on EB2 with priority date of July 2011. In 2018 my employer moved the office to a different state and I am working from home from past couple of years. I didn't move with my employer.

 

* What will happen to my PERM process, if I move to a different state? Do my employer has to start the PERM process again?

* With October visa bulletin, if I downgrade from EB2 to EB3 and file my I485, will I be able to move to a different state?

I am in a similar situation as yours. My PERM was applied with my employer address as working location but I have never worked in that state so far. My date is current now so for filing 485 ,Do I need to Amend my already approved PERM under my employer's location now and re-apply using the current working location ? Did you find an answer for your details.. Could you please let me know..Appreciate your help.

Hi

Before filing my attorney told me that they will not be able to file my downgrade and said the PERM is filed for Metropolitan area and i am living in a different location and working from home. I am in the same situation of yours. I don't know the answers yet, if you have any answers to it could you please let me know. I appreciate your help.

If the PERM doesn't list you actual work location (or doesn't have wording like "multiple unforeseen locations") it would have to be refilled.
