My H1b is expiring end of next month(but I have an option to reclaim the days i spent outside the country - until Feb) and my GC processing has come to a halt. I am taking up a new H1b job and the new employer has filed for both my H1b and reclaiming the days i spent outside the country. However, the date on my I-94 end on September 02, does this mean i have to leave the US no matter what? If my visa is approved and days spent outside the US are re-claimed, can i continue to stay in the US? Or Does the I-94 date override the days reclaimed by my new employer? Quote Link to comment

Mav777 Posted August 30, 2020 Report Share Posted August 30, 2020 Your email is confusing. The h1b extension approval notice will have a new i 94 attached to it. The new i 94 date should match the requested extension ie till feb 2021. Quote Link to comment
