Since the h1b petition is approved under consular processing i will have to go outside USA for h1b visa stamping which is difficult due to COVID-19. My employment with the current employer will end on 1st Oct and my active visa status is L1b. In such case if i apply for H1b COS amendment under premium processing, will I be eligible for H1b cap exemption meaning eligible to join some other company while the amendment is still pending ?
