Can a PERM be filed my new employer in 8th year while waiting for BALCA appeal?

My PERM was rejected in 2019 due to my employer's wrong job posting. I got my 7th year extension and now they are filing my 8th year extension because it is waiting for BALCA appeal. I don't trust my employer or my attorney to do the right thing. My H1B is valid till December 2021. Can i file a new PERM with a new Employer

Yes. Multiple employers can file multiple PERMs for the same beneficiary at the same time. GC is for a future job.

Note just filing the PERM will not allow you to extend your h1b unless the PERM is in pending status for at least 365 days.
