Working outside US while waiting for Priority Date to be current

Recommended Posts

Hi Friends,

Just like many of you, my i140 has been approved but am waiting for my priority date to be current that can be 5-10 years. In the meantime, I want to go and work Outside US; do I need to file any application to keep Green Card process active? Also what needs to be done to come back when it becomes current?

Really appreciate any insight on these.

Regards,

Mayank

Unlike most other countries, a large majority of US Employment-based Immigration implies a job offer first. If your employer has branches worldwide, you can have them consider letting you work elsewhere while waiting for the GC.

You have an approved I-140. You retain that PD. Say 10 years down the line that date is current and the current sponsor will not have a job for you, you can have another company file with PD retention and should you be here at that time say in H1 status, you can have a concurrent filing of the I-140 and AOS.

Many roads to Rome.
