Shiva07201992
Hi guys, My H1 got approved this year on the consular process and I got I-797B which means I have to go to India for stamping. And, I want to transfer it to another employer since before I go to India, Would it be an issue if I change my employer on I-797B? Thanks! Quote Link to comment
gopalakrishnach
My H1 got approved this year on the consular process and I got I-797B --- I feel this is your first H1B. If yes you cannot transfer it before activating it. You need to activate it first and then transfer. Activate means you need to start your H1B and work for petitioner and better to get 2 to 3 paystubs and you can transfer than. Look into activating it. You need to get stamped out of USA if it is H1B consular process and now since all embassies are not doing H1B stamping I do not know how you can activate it. If it is not first H1B then I feel you can transfer to new employer. Quote Link to comment
