I have a 5 year old H1B from another employer which was stamped but never used. The case status of the H1B is showing as "Revoked". Not sure about the reason for revocation. JoeF Posted July 28, 2020 Report Share Posted July 28, 2020 Since you did not work for the employer the employer by law had to inform USCIS about that fact, which resulted in revocation. Since you got the H1 visa stamp you should be cap-exempt. Quote Link to comment

Not sure about the reason for revocation. ---- As per the law whenever employee do not work for the company, employer will let USCIS know and revoke the approved H1B. If not they need to employee. So your case is normal and legal. Will I be able to apply for a Cap Except H1B visa transfer? --- Since you already have first H1B approved and also stamped any employer can apply for new H1B ( transfer ) anytime of the year without going through lottery.
