Me22 Posted July 20, 2020 Report Share Posted July 20, 2020 Hi all need your valuable suggestions here, As my H1b is approved, before giving me the document my employer have me signed an agreement that says I need to stay with him for 3yrs or else I will be liable to pay $xxxxx. Is it really like this, some colleagues say me that we are not bound to any employer as we are free to transfer H1 to any other employer if we get a good employement. Will I be liable to pay what ever the amount as per contract. Thanks Quote Link to comment

An employer can ask for liquidated damages, but that's never a fixed amount, and gets lower over time because the employer makes money from your work. Quote Link to comment
poojB Posted July 22, 2020 Report Share Posted July 22, 2020 You may transfer H1 b, but as you signed contract he may hold you liable to pay for signed % and or agreed amount. You are stuck with that employer for 3 years. Better contcat some attorney to go over it. Quote Link to comment

User099 Posted July 23, 2020 Report Share Posted July 23, 2020 Are you in EVC model? If yes, then if the client ends the contract then you employer will automatically let you go if he can't pay you. If he is not paying you, you can file a complain. If you perform well then you client will extend your contract (wink wink). Zodiac System Posted August 2, 2020 Report Share Posted August 2, 2020 (edited) Employer spends lot of money (thousands of dollars) on H1B filing + attorney fees. In this COVID-19 situation, I have seen many clients terminate contracts abruptly and then the employer terminates the employment as he does not want to pay the employee, when he is not getting paid by client ......
