H-1B approval under Consular Processing

Hello Friends,
 
Asking on behalf of my Cousin:
 
His H-1B petition was approved under Consular Processing and he received I-797B.
 
If he gets a good job offer from another employer, Can he transfer the Approved I-797B from the current employer to future employer and go to stamping with the future employer ?
 
Asking this because H-1B status gets activated only after the Passport gets stamped, as we all know new H-1B stamping is not possible till December 31st of this year.
 
Inputs are highly appreciated.

1. Unless activated with same employer it can not transferred to new employer

2. Employer who have spent lot of money and time on this if gets hint he may cancel before activation and he can say goodbye to this h1,

No, he has to start working for the original employer on the H1 or at least get the visa for the original employer before a transfer is possible.

Since it was consular processing, you are not counted against the cap till you get stamping done. You can only transfer after your stamping is done.

You answered your question. NO he cannot do.

Asking this because H-1B status gets activated only after the Passport gets stamped, as we all know new H-1B stamping is not possible till December 31st of this year

He needs to get stamped come to USA start H1B and then only can he do transfer.
