NishanthSundar 0 Report post Posted July 15, 2020 Hello Friends, Asking on behalf of my Cousin: His H-1B petition was approved under Consular Processing and he received I-797B. If he gets a good job offer from another employer, Can he transfer the Approved I-797B from the current employer to future employer and go to stamping with the future employer ? Asking this because H-1B status gets activated only after the Passport gets stamped, as we all know new H-1B stamping is not possible till December 31st of this year. Inputs are highly appreciated. Thanks. Share this post Link to post

JoeF 7 Report post Posted July 15, 2020 No, he has to start working for the original employer on the H1 or at least get the visa for the original employer before a transfer is possible. Share this post Link to post
User099 0 Report post Posted July 16, 2020 Since it was consular processing, you are not counted against the cap till you get stamping done. You can only transfer after your stamping is done. Share this post Link to post
