ranjitation
Hi, I have one week left in my H-1B unemployment grace period. I accept a job offer last week and completed the visa questionnaire for the law firm. They are yet to update me on whether they have applied for my LCA and visa transfer. I have not received any receipt yet that my case is being processed. Should I apply for a change to a B2 visa just to be safe and maintain my status or should I be okay since I've accepted a job offer? Thanks in advance! Quote Link to comment
User099
You should atleast have the I129 petition sent to USCIS by the last date of your grace period. Just accepting an offer doesn't mean anything. If they are not able to file in time, you should consider B2 visa. Check with the attorney and they should be able to speedup the paperwork as you have a time crunch. Quote Link to comment
gopalakrishnach
Accepting job offer will not count. USCIS must have the petition in their hand before your grace period ends. Talk with your employer/ attorney and I feel they can help you here. I do not advise applying for B2 without talking with an immigration lawyer.
