I have not traveled out of US and nor have I got H1-B stamped. I am still working on my F-1 Visa STEM OPT (12 months remaining) Now, I have alternate offer. Does my new employer just follow the H1-B normal transfer process? If yes, will that be consular to consular OR consular to change of status? If my transfer is consular to consular, do I need to get my visa stamped before starting to work for new employer? Quote Link to comment

User099 Posted July 1, 2020 Report Share Posted July 1, 2020 You are not yet counted towards the cap as your was a Consular processing case and you still don't have a visa. In that case, new employer can't file for a transfer, they will have to do a cap case for you again. Quote Link to comment
