isusernamemandatory 0 Report post Posted June 25, 2020 Hi, My H1B 6 year max out is by July end. My PERM was filed on April 2020, with no updates yet. My employer has initiated a Canadian visa for me (yet to approved). Does the 60 day grace period after H1B expiry apply for 6 year max out cases like me ? With current EO and restrictions on traveling back to US, will there be an issue if i overstay (without working) after my visa expiry till my Canadian visa is approved and travel to Canada from US ? Thanks Share this post Link to post
Mav777 0 Report post Posted June 26, 2020 No, grace period is not applicable in your case. Overstay should be avoided. I would ask the company lawyer about the course of action of travel back to India or to Canada is not possible due to covid restrictions. Share this post Link to post

Thanks Did you already request H1 extension equivalent to the number of days you were out of USA in the past 6 years? Share this post Link to post
rajib01 0 Report post Posted July 14, 2020 Hey there, how did your employer initiated Canadian visa? Does your employer have office in Canada? Is it a temporary work permit? Do you need to apply for stamping in Canadian embassy? I am also in the same boat and thinking to move to Canada. Your reply will help a lot. Share this post Link to post
