banking few days in 6th year max out for H1B Extension from India with I140 approved.

Recommended Posts

I lost my job this month, at a very critical point as my H1B 6 years are completing on 20 Sep 2020 (Actually my 6 years will be complete by 20-Aug-2020 but have visa till 20-sep-2020) and I140 is still in process.  Now my contractor said he can’t apply for extension based on only I140 (assuming will get approved soon) without new project.
My question is to use H1B cap exempt extension from India how many days should I keep in H1B unused or till what time I can stay in US and search for new project and still apply for cap-exempt extension from India.

Highly appreciate your advice or direction in this regard

You don’t have to leave any “unused” h1b days on your visa. Leave the country on or before August 20 if you can’t find a job by then and apply for an extension. Post aug 20  the new company can apply for an extension for cap exempt h1b while you are outside the country.
