leesiva
Hi, I am FTE to a US based company. My company announced the Work from Remote option till the end of this year due to COVID. Due to personal reasons, I would like to travel to India in Aug and work from there temporarily until the end of this year(5 months) . I have H1B stamping till Aug'21. Recently my company immigration filed an LCA for a remote worksite. 1) Can I work in India on US payslips being H1B visa around 5-6 months ? Anyway my company announced WFH till the end of the year. Instead of working remotely from the USA, I would like to work in India . 2) Will there be any consequences at POE while returning back to the USA after working 5 months from India? 3) Will it impact my H1B status or PERM or Green card processing? 4) Is it legal to work remotely on US based salary for this long period on H1B? 5) If not this 5-6 months, How long can H1B resources work maximum from India remotely on US payslips without affecting H1B/PERM/Green card status? gopalakrishnach
1. I guess you can work but need to play taxes in India and also in USA. 2. Nope. You can take letter from your employer explaining that they allowed you to work from India. 3. I guess nope. 4. I guess you are good. 5. I am not sure. Quote Link to comment
User099
You can work from India, but make sure your employer is aware of it. At POE make sure you have proof that the job still exists after 5 months of staying away. Quote Link to comment
ashuneel
You are not in H1 status once you leave US. your visa is valid. Quote Link to comment
