Leave of absence

Recommended Posts

My 60 day grace period started on the 1st of May and my employer was keeping me on leave of absence. Now I found new jo on the 15th of June and start H-1B Transfer. But what should I do next? Should I wait for an H-1B transfer? If I get rejected afterward in transfer, then my 60 days grace period will already be over and If I apply for B2 or F2 from H1B then I probably lose my H1B instead of having a job?

If your employer is not paying you and keeping you on a leave then its not good. You will have 60 days to file for a transfer.

You should file the transfer and you can work on the receipt notice with the new employer. If the H1 is rejected, you should leave or file a B2 as a temporary measure.

Its better to talk to an attorney if you think the H1 might get rejected and make plans accordingly.
