taurus03 Posted June 15, 2020 Report Share Posted June 15, 2020 Here is my situation and any information is greatly appreciated: My 6 years H1B will be over in December 2020 and with no GC initiated by my employer I had applied for H4 EAD and today I see there is change of status shown for my i-765 saying 'New Card Is Being Produced' however no update on i-539. My question is when do I let my company know about this? As there is still no update on my H4 status can I continue to work on H1B even upon approval of my H4 EAD? What is the procedure for change of status from H1b to H4 EAD? Will there be any gap in my employment with this? Thanks Quote Link to comment

User099 Posted June 16, 2020 Report Share Posted June 16, 2020 You will need the H4 to be approved to use the H4 EAD. You should wait for H4 appoval notice and H4 EAD Card before letting your employer know about this change. Most likely there will not be any gap. Quote Link to comment
