Santhosh.4561 Posted June 12, 2020 Report Share Posted June 12, 2020 Hi, My L1A/I94 is getting expired on 31-Aug-2020 and my employer has already filed extension last in Apr-2020 and receipt received. In the current situation expecting to be delayed OR getting RFEs which may get delayed to get final approval. My 7 year max out will be May 2021. 1. During this time, till my L1A extension approved, Can I continue to work with my employer till 240 days after my I94 expired? 2. Can my employer file my I140 now and get it approved before my max out time used on L1A? 3. Can I file my I140/485 concurrently in this situation. 4. What is the chances of getting L1A approval in this current immigration situation. Including Covid, USCIS, RFEs. Thanks in advance for your answers. Santhosh. Quote Link to comment
Attorney_15 Posted June 17, 2020 Report Share Posted June 17, 2020 Someone who has a timely filed extension of L1A status can generally work for 240 days after the expiration of the I-94 Card while the L1A extension petitions is pending with USCIS. Quote Link to comment
