I94 expired and H1b extenssion denied

I-94 expired in March 2020 and H1b extension denied early Jun (yet to receive the letter). I have I140 approved. What are my options in current Covid19 situation and travel restrictions. I am not in travel ready stage (one of kid us passport is expired. and renewal is still in progress)

Your suggestions and help are much appreciated.

I don't this there is an option in your situation. Have to leave country asap.

You may be able to file COS to B2 with reasons of travel reatriction and the assitional time you need to get your kids passport.. and travel as soon as you can and file for h1.. and come back after your H1b is approved..i am not an attorney, please cross check..

You can file for B2 by using Covid as a reason for not able to travel. You can also check with an attorney to see if you qualify for a compelling circumstances EAD with approved I140.

What are the options for refiling H1b with same employer or another one with special situation of not able to travel? Does anyone know if they are giving I94 and allowing to start working without travel in the travel ban situation. Off course we will plan to travel & Stamp when it is open/available.

After you receive your denial letter see if you can appeal the denial that will allow you to stay legally. Just refilling will not be of any help if there is no change in your situation from the original petition.

Talk to an attorney since your case is complicated and your family is dependent on it.

You may file h-1 and wait for approval to start working again.  Air India is opening bookings from 10th June (US govt also knows this so travel ban might not work )... but u may be able to get relaxation due to your kids passport.

Better B2 rather than H1B since it might lead to same result. If your case improved then H1B better. Understand what is reason for denial.
