Meanwhile, I have some pay cuts in my H1 employment. Can I use I-912 fee waiver form with this situation explained? I would like to know if there are any restrictions that H1B holders cannot use I-912 fee waiver form. Please advise. Quote Link to comment
newacct Posted May 30, 2020 Report Share Posted May 30, 2020 No. According to the I-912 page, under Listing of Forms Eligible for Fee Waiver, I-539 is eligible for fee waiver "only if you are applying for any benefit request specified by section 245(l)(7) of the INA or applying for E-2 CNMI investor nonimmigrant status under 8 CFR 214.2(e)(23)". I don't think a B2 extension falls under those. Quote Link to comment
