RFE : H1b extension on Educational Requirement wide variety of disparate field of study

Hi All,

I recieved rfe (Specialty Occupation) on H1B extension EVC model, QA Engineer, Wage level 3 . Education Requirement for preferred position is "Education requirement for this position is US Bachelor’s or a foreign equivalent degree in Computer Science, Information Systems, Management Information Science, Business, or a relevant engineering degree "

 

RF states : "You indicate that one of the minimum entry requirements for proffered position is a degree in Business Administration without further specialization or explanation. You have not explained how this generalized field is a “body of highly specialized knowledge” that is directly related to the position.”

Basis of the educational requirement alone, you have not established the position is in a specialty occupation.

Anyone on this boat and got RFE approved? I have bachelors in IT and MBA in IT.

The problem here is that the employer seems to have listed an overly broad range of degrees that are acceptable for employment. You might want to speak with a lawyer to discuss what strategy is possible if any to try and get an approval of this petition.
