I797 Date is Incorrect

Hi,

Please help:)

I applied for H1B transfer with the new employer. I got my I-797 approved with the start date of 04/21/2021. My I94 expiration is 06/27/2021 which is the same as the end date on my current I797 (present employer). My last date with my present employer is 06/05/2020. Given my present employer will revoke my H1B on 06/05/2020. Does that make me out of status from 06/05/2020 till 04/21/2021. My start date with my new employer is 06/08/2020.

You can't start with the new employer on 6/8/2020 as the petition is not approved for this date. Why did your employer apply for the start date as 4/21/21? Was it a mistake in the paperwork or a mistake by USCIS?

If the mistake is by USCIS, they should be able to fix it if your employer reaches out to them.
