vsrupa7 Posted May 21, 2020 Report Share Posted May 21, 2020 My H1B 60 days grace period ends on June 14th 2020 where as my H1B expiration date is 06/28/2022 and on my I94 it says: Admit Until Date : D/S which I believe will be the same as the H1B expiration date which is 06/28/2022 (please correct me if I am wrong) So, can I stay legally in the US until Oct 12th 2020 as it the 180th day after my H1B was revoked? Does that mean I have until Oct 12th 2020 to find a job and file for H1B Transfer however I have to go out of country for the visa stamping if the H1B Transfer was filed after the 60th day? That's only for F1 I-94s. An I-94 that specifies H1 status has a specific end date. Quote Link to comment
User099 Posted May 21, 2020 Report Share Posted May 21, 2020 You should have got a new I94 when you filed for H1 which had the I94 expiry date on it. Were you on F1 before converting to H1? You might have got the i94 with D/S for F1. I replied to your other post, check there. You are getting confused by the 180 days period, there is no such 180 day period while you are H1. Then you need to file H1B with in 60 days of last working day or last date of I94 which ever comes first. If this is did not happen then I feel you will be out of status and need to leave ASAP. You should file a COS to B2 citing the pandemic and if you land a job in the meantime, leave and return with the H1 Visa. Staying beyond 60 days means you are out of status and not subject to bans.
