member24
Can the amendment petition be filed with extension of stay, even one year before the expiry of the current petition? If so, in case if the 'amendment petition with extension' is denied by USCIS - will the original petition still be valid until the stay date mentioned in the original petition? or Will the stay become invalid if the 'amendment petition with extension' is denied? Yes, amendment can be filed any time there is change in the job. Even if its 1 year before. Original petition will still hold good only if you still have the old job for which the H1 was applied. gopalakrishnach
Normally extension is filled only 6 months before expiry not 1 year and I feel USCIS will not accept. I maybe wrong. Quote Link to comment
02112018
Yes you may file amendment petition with extension of stay. It may affect your current validity if officer change mind. I would say just file only "amendment" now. Quote Link to comment
