Jags004 Posted May 12, 2020 Report Share Posted May 12, 2020 (edited) My H1B petition got approved but (COS) Change of Status was denied from F-1 to H1B. COS was denied as i travelled outside USA and returned before approval. The notice also says : "The beneficiary may remain in their current nonimmigrant status until the expiration date indicated on Form I-94. Also it says "The approved Form I-129 for H-1B nonimmigrant classification has been forwarded to the Chennai Consulate as requested in Part 4 of the Form I-129." My stem opt expire by August 2020 and i'm also maintaining the valid status as F-1. Meanwhile Can i transfer this approved H1B petition to a new employer? Also can i apply for new COS? I'm no longer with the same employer which makes it complicated for me and so i'm looking to transfer the approved H1B petition. What are the options? JoeF Posted May 14, 2020 Report Share Posted May 14, 2020 For the H1 to be valid you would have to start working on the H1 for the original employer. Since you are no longer with the employer the H1 is gone. Quote Link to comment
