H1B Change of Status

Hello,

My last day with employment was 14th April 2020. So my 60 day grace period will end on 14th June 2020 ?? If i apply for change of status to B1/B2 on 10th June 2020 and if i end up with a new job on 30th June 2020. Can i apply for change of status to H1B while my B1/B2 is pending ?? Do i have to wait until B1/B2 is approved to come back to H1B visa ?

If Air Travel resumes by then, your COS may be considered frivolous. On the other hand, it seems unlikely and you can apply for a COS to B2 based on the COVID situation. At some point in time, you will need to leave and return with an H1 visa.

This depends on the H-1B approval type.

1. If only H-1B petition approved but COS denied (i.e. H-1B approved without I-94); a person has to leave the US and come back with H-1B visa to start working.
2. If H-1B and COS both approved (i.e. H-1B approved with I-94 attached); a person can start working and no need to leave the US or new H-1B stamp.
