H1B and H4 are expiring soon

Recommended Posts

Hello, I am currently on H1B extension valid until May 31st
2020 and my Spouse H4 is also valid until May 31st 2020.
We are currently stuck in India due to COVID-19 situation since march. I do
have some questions can you please clarify on this

1. My flight is now scheduled on May 27th 2020, will there be any issue at
port of entry for me and my spouse since our H1B visa and I-94 are valid
for 4 days only?
2. Should me and my spouse travel on May 27th or wait for my H1B filed
under consulate processing and get it stamped in India ?
3. What are the necessary immediate steps to be taken if me and my spouse
travel on May27th and find no issue at port of entry ?

Please advise and waiting for reply

1. May create some inquiries at port of entry.

2. New petition, get stamped and come back. Thats best way.

3. If you come back employer need to file petition ASAP before I94 expiry

Take some legal advice from an Attorney before traveling. You will have 2 working days to file for an extension, just keep a note of it.

@gopalakrishnach My employer is filing H1B under consulate processing and also applying H4 as well.

1. By the time i travel May 27th, if i receive receipt for both H1b and H4 visa's - Is it safe to travel

2. As soon as New i-94 is generated on May 27th, My attorney  will file for regular H1b and H4 processing
