I94 expired, what is my situation after 240days?

Hello,

H1b extension was filed under regular processing  and I94 was expired on October 7th.

Received a RFE on Jan 2nd and response was submitted on March 25th and 240 day is June 5th.

Question:

1. What is my situation after 240 days due to covid19? Can I continue to work?

2. If I have to stop working after 240 days, do I need to leave the country immediately?

3.  is my presence in USA will become unlawful after 240 days if I don’t leave?

Assuming that 240 days apply to you.

1. After 240 days you can stay in USA but cannot work.

2. No. You can stay in USA until decision.

3. If petition results good then no. If results in bad I guess you need to leave ASAP.

No you can't work after 240 days and have to exit the country.

1. You can't work but you can stay till Extension is pending.

2. No, you can stay.

3. No, since you timely file for H1 extension you will not be considered unlawful.
