Selected in Lottery but got laid off

Recommended Posts

Hi

I am currently on L1B visa. My company registered for the H1B lottery for me in March 2020 and I got picked up in the lottery. My application has not been filed by lawyers yet.

I got laid off from the company due to the recent Covid situation.  (April 2020)

Question

1 Can I use my H1B lottery registration to file for approval with a new company? (I understand I need to find a new sponsor company but my question is will it be allowed sine my H1B is not yet approved I just got picked up in the lottery)
2. If Yes - By what time I need to find the sponsor and apply for it
3. If No- Can this picking up in H1B lottery waste in this case or can be used in any means.

I am sorry to hear that.

This H1b is gone. You will have to apply through lottery again next year.

1 Can I use my H1B lottery registration to file for approval with a new company? -- I guess no since H1B petition is employer's not yours. So you cannot use one employer lottery to another employer petition.

2. No

3. I guess this is waste. Only picked can be used by employer you submitted the lottery.

1. No, your employer filed for you in the lottery so he will have the right to file a petition.

2.

3. Its wasted. Someone else will get that slot.

Thanks for the response. Fortunately, lawers have filled for the application before my lay off date and they have provided me with the receipt number now.

Its not yet approved but filled and have a receipt number. Do this help in anyways?

I don't think it will help as you lost the job. Employer will withdraw the H1 if you don't work for him.

That H1 is gone. You don't have a job with the company, so you can't get the H1.
