H1 Max out the end of 2020 and perm not submitted

Hi,

Below are my dates -

- Current H1 max out date (1/1/2021)

- Prevailing wage submitted (3/19/2020)

- Recruitment started (late March), but two postings can not start as they have to be in the office and everyone is wfh now

Here are my questions -

- If everything goes well and I can get my perm approved before the H1 max out date (1/1/2021), can I get one year extension?

- If I can't get my Perm approved before max out date, do I need to be abroad for 365 days? If yes, can I come back to US after 365 days and get my H1 extended for another 1 or 3 years?

PERM pending 365 days means one-year H1 extensions beyond the initial 6 are possible. Approved PERM gives you no extensions.
