samandy Posted April 23, 2020 Report Share Posted April 23, 2020 I want know about my current situation on H1 B Extension, My employer has filed an extension on June 20th 2019 with USCIS in regular processing. On August 9th 2019, my i94 got expired. From then I was working on 240 day rule and upgraded my case to premium in Jan 2020 and received RFE on Speciality Occupation. Then My Employer has responded in March last week and received a 2nd RFE in April 1st week. My 240 day has expired on April 5th 2020, So will I be able to stay in US legally and work after 240 days. Your H1B extension was filed before I94 expired you have 240 days rules. You can stay after 240 days until you get decision but cannot work after 240 days.
