I was supposed to travel back to US mid March but due to COVID lockdown I got stuck here. I have been working remotely for the last few weeks. Under the current circumstances I don't think I will be back at least until Late May / Early June. My question is do I have to file a new LCA since I am working remotely from India? or Is there a certain #of months I can work remotely without applying for one? Please let me know. Thank you. JoeF Posted April 20, 2020 Report Share Posted April 20, 2020 You are by definition only on H1 when you are in the US. What you do while abroad is of no concern to USCIS. LCAs also only apply for work locations in the US. Quote Link to comment

LCA and H1 only apply when you are in US and not in India. There is no need for any amendment. Quote Link to comment
