Neel Dey Posted April 6, 2020 Report Share Posted April 6, 2020 Hi, my L1-B visa is about to expire and I can change my status to H4 (since my spouse has an H1-B). My question is - If I change my status to H4, will it start my cooldown period (while I continue to be in US on H4) OR Will my cooldown period start after I leave the country? Follow-up question - While serving cooldown period outside the country, can I intermittently travel to US on B1 or H4 visa? Or does the cooldown period warrant staying outside the country for 1 year continuously? Quote Link to comment

Attorney_15 Posted May 6, 2020 Report Share Posted May 6, 2020 One cannot qualify for an addition period of L1 time (or H1B time) by changing to another status in the United States. If someone reaches their L1A, L1B or H1B maximum, to qualify for the full period of status, they must leave the United States and be outside for an entire year. Quote Link to comment
