Can we file 7th Year extension based on PERM approval

Hi,

  Below are my dates.

PERM filed on--Aug-05-2019 (Audit responded on Jan-21-2020)

Current VISA expires on -- July-21-2020

Max Out on-- Aug-25-2020

 

Being I 140 Premium suspended and by looking at above dates, if my PERM approves in next couple of weeks, can i apply for my H1B 7th year extension based on PERM approval and PERM is filed 365 days prior to Max Out? could you please help.

With an approved PERM, you can go for 1 year extension.

Hi,

 

 i am in the similar situation . My PERM is currently approved and i'm waiting for I140 approval and this may take a while as premium processing is suspended. 

i will finish 6 years on my h1b by 05/11/2020. 

My legal team said we cannot apply for 1 year extension when waiting for I140 even after PERM is approved . Please provide me references to this topic from USCIS websites that i can submit to legal team for applying for 1 year extension.
