If employer has terminated the employment and notified the USCIS, then though the H1B visa on one’s passport may be facially valid, s/he may not be able to travel back to the U.S. If the employer holds the postion and advises to commence employment in a few months, then it is important to carry documents to evidence availability of position in the U.S. It is possible for a new employer to file another H1B while you are in India.
