H1B Extension Denied and I94 Expired

Recommended Posts

Hi All,

My H1B Extension with the current employer is denied on March 15, 2020, and my I94 is expired on Nov 10, 2019. I am terminated from my employment on the same day.

Note: The current Employer filled for H1b extension before I94 expired.

Questions:

1) When did my unlawful presence begin?

2) Can I stay in the US and look for new opportunities? If yes, How?

3) Is there a way to extend my stay lawfully in the US at this time (considering Covid 19 situation and I am an Indian Citizen)

4) Any suggestions ........

Thanks in advance.

You have no grace period because the I-94 is expired. That also means it is not possible to file a change of status.

1.  March 15th

2. No, you should leave asap.

3. You can file an appeal for the denial and stay while its pending.

4. Why was it denied?

From the day your H1B extension denied your unlawful presence started. It is March 15, 2020.

Leave ASAP or file for an appeal and during that process you can stay but cannot work...
