Rishi Sajja
Hi I got laid off last month on February 11th so my grace period is till April 10th(60 days ). But I got a job already and the new employer has already sent the transfer case to USCIS on March 19th and we did receive a case number (Premium processing). My start date originally was on 03/30/2020 but due to the COVID-19 state emergency, the client has postponed my joining date to May 1st (05/01/2020). Question: So how many days can I be unpaid (without running the payroll) considering my transferring case gets approved or RFE. Note: My grace period ends on April 11th and my home country has locked-down all the international travel Quote Link to comment
User099
You can be unpaid and wait for the petition to be approved. But after its approved, you will have to join the new employer and it will depend on when you are available for work or join them. Once you report to work, they should start paying you. gopalakrishnach
You can be unpaid and since you have receipt number I feel you stay in USA. Your joining depends on your employer. Once you join them and start working they need to start paying you. Quote Link to comment
