SSV236
Hello, my employer filed my H1B under consuler petition. I am still in USA working for the same employer on my STEM OPT. My EAD is going to expire in July 2020. I have booked my flight and schedule a H1B visa interview for April 10th. My appointment got canceled because of COVID-19. I asked my attorney to file for Change of status and my attorney said its not an option for me. If I don’t get the H1B stamp before my EAD expires, what are the consequences related to my immigration status. And what are other options? Thank you Quote Link to comment
User099
All I can say is to wait and see if there is any improvement by your EAD expiry date. If your EAD expires and you can't get the visa by then, you will have to stop working. But you can always go for stamping and come back on H1. Quote Link to comment
gopalakrishnach
I can understand what you are going through. Now all you can do is wait and see. If you do not get visa by the time your EAD ends I guess you cannot work since you will not have any work authorization. I may be wrong. Please ask your attorney. You can come back and start working. You have to come back with H1B visa stamp. Quote Link to comment
