ANC89 Posted March 6, 2020 Report Share Posted March 6, 2020 Hi, I got my I-140 approved very recently (priority date - 09/03/2019) and when I check the status in USCIS website, it says - "On February 25, 2020, we sent your case, Receipt Number XXXXXXXXXXXXX, to the Department of State for visa processing". My attorney opted for CP since I am in India now. I came back from the US on June 5, 2019 since I maxed out 6 years on H1B. I have 2 questions : (i) My employer is currently saying that they will file a cap-exempt H1B for me on basis of my approved I-140 so that I can go to the US and work for the same client. It should not be a problem for me to travel to the US if my H1B is approved, correct? (ii) Once I am in the US, is it possible to change from CP to I-485(Adjustment of Status), or should I stick to CP. Any response is helpful and highly appreciated. Thanks a lot in advance.
