rush91
I was laid off from company A and then I found a new job with company B. Company B has filed for my H1B visa transfer petition and I have already started working with them. However, I got another job offer from company C which I am more interested in. If I now move from company B to C, will company C have to file for a H1B transfer from B to C or they can still file for transfer from A to C. Note: 1. I am still within the 60 day period after being laid off from company A. 2. H1B transfer petition filed by company B has not been approved yet. It is just submitted to USCIS. Please advise. User099
You can file for a transfer to C with A's petition proving your legal presence. But I would still mention it to the attorney about B's petition. Quote Link to comment
