Visa Stamping with approved I-797 for previous client

Recommended Posts

Hi, I am on H1B and has a approved I-797 till 2022 for a client XX, location new york. However i have recently moved to  client YY, Location Florida with same employer. My employer has filed a amendment which will take another 9 months to process as per current processing time of center. I do not have visa stamped on my password right now and i am planning to go india soon. In that case, can i go for visa stamping with my  approved copy which is valid till 2022 with client xx. If not, is same case applied for my spouse also who is on H4.  Thanks.

You should wait for H1B Amendment to be approved. As you are no longer working for old client it is not recommended to use that petition for visa stamping purpose. Try to expedite your processing by upgrading to premium processing if that is available.

If they contact Client XX and if they say you longer work for them they will issue 221G and might lead into problems.

They might also see that you have pending application so might wait to see result of it. Again issues.

Convert your pending application to premium processing. That will be good for you.

I think it should be ok as long as you are with the same employer

No, its not correct. They will try to verify with the client and see that you don't work there and will treat it as if you lied to the VO. You will get barred for lying.

What ever @gopalakrishnach said will apply for H4 too. She will get 221G and they will ask her to wait till the amendment is approved to give her a visa.

I do not think it is not OK. If USCIS try to contact client OP will get into trouble.

That is not right. It is a huge risk in the current situation unless the person is really lucky. They ask for client letter and verify it against your I-129 location.

Why can't you go for premium processing. That is a safe option right.
