kkumaar Posted February 24, 2020 Report Share Posted February 24, 2020 Hello, I am planning to marry a Divorced girl in India who has a Kid. I am in US (H1-B status, holding I-140). Since she has her divorced documents available, after I marry her I can register my marriage in India and can bring her as my dependent. What is the process for bring her child along with me, like should I adopt him in India and then process him as my dependent? Any insights or experiences are most appreciated. Quote Link to comment

newacct Posted February 26, 2020 Report Share Posted February 26, 2020 For US immigration purposes, a step-child is treated the same as a biological child if you married the child's parent before the child turned 18. There is no need to adopt the child. Quote Link to comment

However, please be aware that under United States law, a stepparent and the biological parent of the stepchild must get married before the child turns 18 years old."
