Visa for my future wife's son (she is divorced)

Recommended Posts

Hello,

I am planning to marry a Divorced girl in India who has a Kid. I am in US (H1-B status, holding I-140). Since she has her divorced documents available, after I marry her I can register my marriage in India and can bring her as my dependent. What is the process for bring her child along with me, like should I adopt him in India and then process him as my dependent? Any insights or experiences are most appreciated.

I am not an expert, but once you register your marriage your spouse's kid will be your kid too..right?

Why would you have to adopt him again?

For US immigration purposes, a step-child is treated the same as a biological child if you married the child's parent before the child turned 18. There is no need to adopt the child.

"You may file an immigrant petition for a stepchild without having to legally adopt your stepchild. However, please be aware that under United States law, a stepparent and the biological parent of the stepchild must get married before the child turns 18 years old."

Loads of information if you GOOGLE.
