I-140 Approved with Employer A. i have only couple of months left out of H1B 6 years. Can i transfer my h1 to new employer if my current employer is not willing to do re apply. Do New Employer need to file PERM and I140 immediately Do i need to wait for cooling period ie 1 year to apply for h1 extension/transfer. Appreciate your time for response. Quote Link to comment
User099 Posted February 17, 2020 Report Share Posted February 17, 2020 If your I140 is approve for more than 180 days, you can use that to request for 3 more years of H1 with any employer. If not, then the new employer will have to file for Perm and I140 immediately and do H1 on basis of it. You can use the remaining H1 period (couple of months as you said). Quote Link to comment
