prianca152
Hi, I am currently working in US on STEM OPT which is valid for two more years. If I get my H1b approved via employer A through consular processing, I believe I have an ability to choose the start date for H1b. Can I switch to employer B using my STEM OPT before the start date of H1b? Quote Link to comment
JoeF
No, you would have to start working on the H1 for the original employer before a transfer would be possible. Quote Link to comment
gopalakrishnach
Nope you must start your H1B before changing employer. That means you must work for the original employer who got your first H1B approved... Quote Link to comment
User099
Since you are still on OPT, you can switch to Employer B and work for them on OPT. But your H1 can't be transferred to Employer B. If you leave Emp A and he withdraws the petition, you will again have to go through the lottery. Quote Link to comment
prianca152
@JoeF Thanks for your response! If I get my H1b approved in June via consular processing, can I immediately get it stamped or do I need to wait until October? Quote Link to comment
gopalakrishnach
You need to wait till Oct to start your H1B. You have to atleast get 1 or 2 pay stubs from Emp A before you transfer to Emp B Quote Link to comment
