Satishch Posted February 10, 2020 Report Share Posted February 10, 2020 Hi Team, My petition was issued with an RFE on Employer Employee Relationship, Specialty Occupation. We have submitted all the requested documents except client letter(As per client policy they are not willing to share), we shared MSA, SOW(End date Jan- 2021) as a supporting documents, how ever my case got denied on Feb6 2020. Awaiting for the denial notice, 1 what is the next step after denial? 2 can i appeal to USCIS/Federal court on my denail? 3 Do we have any time frame to appeal (from the date of denal in howmany days i can appeal) Thanks! User099 Posted February 11, 2020 Report Share Posted February 11, 2020 1.If you I94 is still valid, you can transfer to a new employer or find a new client. If I94 is expired, you will have to leave. 2. Your Employer can appeal the denial, with which you can stay but can't work. This appeal can take more than 6-9 months to process. 3. You will have 30 days from the day you received the denial notice to appeal it. Quote Link to comment
