Mahender Gangu
Hi, Currently I am working for Employer A which is a profit organization and my H1B visa is approved thru Lottery processing and planning to make a transfer to new employer B which is a Non-Profit Organization. In future, if I want to switch back to any Profit Organization, can I do that or are they any restrictions in doing it? Should I undergo lottery processing again and apply for visa? What happens to my GC processing? Non-profit organization will file my GC and after I140 approval, if I am planning to make a move to profit organization, what is the process of doing it? Can I transfer my GC as well? Please let me know. Quote Link to comment
User099
You H1 will not be a problem, you can transfer back to a for profit organization without going thought the lottery again. I am not sure about the GC. Quote Link to comment

pontevecchio
Once subject to the cap, you are free to then mix and match. Quote Link to comment

Yes, Since the first time was a for profit company you can now work for Non-profit or for profit organization. Quote Link to comment

Or can I extend only after new employer files my GC? Moreover it works same for Non Profit or Profit correct? No change in the process? JoeF
You can extend the H1 indefinitely if an I-140 was approved for 180 days. The PD only has meaning for a GC process. And there is no difference with the type of employer. Edited February 14, 2020 by JoeF Quote Link to comment
