They started my GC process and now I have an I140 approved with EmpB but its not 180 days yet from the approval date. I plan to join Emp C soon. 1. Which I140 of mine is considered current and valid in this situation. The one from Emp A or Emp B? 2. As I have not completed 180 days since 140 approval with Emp B yet , If I resign, I understand that Emp B can revoke the I140. In this situation , can I still use I140 from Emp A to get H1 extensions/transfer and port priority date to EMP C? OR I need to wait until 180 days complete? 3. When your current employer starts your GC process and I140 is approved under current employer, does that make your old I140 void and never usable again ? 4. User099 Posted February 11, 2020 Report Share Posted February 11, 2020 If you I140 from Emp A is approved for more than 180 days, you can use it with Emp C for extension and Emp C will most likely retain the PD. A employer can withdraw you I140 anytime, same day as you resign or keep it active too. Quote Link to comment
